GENERAL TERMS AND CONDITIONS OF USE

This website www.domainesandricourt.com (the "Site") is published by CHASSE ET LOISIRS DU DOMAINE DE SANDRICOURT SASU, a SASU, a ‘société par actions simplifiée unipersonnelle’ (one-person limited liability company), with share capital of 54,700 euros, entered in the Trade and Companies Register of Beauvais under the reference number B 815 181 847, whose registered office is located at 12, rue du Château, 60110 Amblainville, France (hereinafter the "Company").

ARTICLE 1 - PURPOSE

These general conditions of use (the "GCU") govern the use of the Site by any user whatsoever (the "User").

In particular, they are intended to define the conditions under which the User may access the content of the Site and browse the Site.

By browsing the Site, the Users acknowledge that they have read and fully and unreservedly accept the GCU.

The Company reserves the right to modify the GCU at any time. They will then be applicable as soon as they are put online. The User is therefore invited to read the GCU regularly.

ARTICLE 2 – ACCESS TO THE SITE

The Site is accessible to all Users, provided they have an Internet connection.

The Site is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of the Company, and subject to any breakdowns and maintenance operations necessary for the proper operation of the Site. Maintenance work may be carried out without prior notice to the User.

Equipment (computers, telephones, software, telecommunication means, etc.) enabling access to the Site is the exclusive responsibility of the User, as are any telecommunication costs incurred by its use.

The Company grants the User a personal, revocable, non-transferable, non-assignable, non-exclusive and free license to use the Site.

ARTICLE 3 - CONTACT FORM

To contact the Company and make a reservation request, the Site provides the User with an online contact form. 

By completing this contact form, the User undertakes to provide true, accurate and complete information as requested in the said form. 

In particular, the Users will provide their first and last name, postal address, e-mail address and telephone number, as well as the reservation formula chosen and the dates requested. This personal data will be processed in accordance with the Site's Privacy Policy.

ARTICLE 4 - PERSONAL DATA

Personal data collected directly or indirectly on the Site will be processed electronically. The User is invited to refer to the Site's "Privacy Policy" tab for full information on this point.

ARTICLE 5 - INTELLECTUAL PROPERTY

The Company is the exclusive owner of all intellectual property rights or holds the rights of use relating to both the structure and the content of the Site, in particular trademarks, texts, images, graphics, logos, icons, sounds, videos, software, etc. The Company reserves the right to modify the content of the Site at any time and without prior notice.

The GCU do not entail the transfer of any intellectual property rights to the User in respect of either the structure or the content of the Site, including the Company's trademarks and logos. The User therefore undertakes not to use the elements of the Site in such a way as to infringe the rights of the Company, and to ensure that such use does not constitute counterfeiting or an act of unfair or parasitic competition.

Any reproduction, representation, modification, publication, total or partial adaptation of the elements of the Site, whatever the means or process used, is forbidden, except with prior written authorization. Any unauthorized use of the Site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code or articles L.713-2 et seq. of said Code in the case of registered trademarks.

ARTICLE 6 - LIABILITY

The Company undertakes to ensure the proper operation of the Site. 

However, it may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

The Users declare that they accept the characteristics and limits of the Internet, and in particular acknowledge:

  • that use of the Site is at the User's own risk, the Site being accessible as is and subject to availability;

  • that they are solely responsible for any damage to their computer resulting from consultation of the Site;

  • that they are responsible for taking all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Site;

  • that they alone are responsible for their use of the information on the Site and, consequently, the Company cannot be held liable for any direct or indirect damage arising from the use of this information;

  • that they alone are responsible for the use of the content of sites with a hypertext link to the Site, and that the Company declines all responsibility for such content;

  • that they are aware of the nature of the Internet, in particular its technical performance and response times for consulting the Site or transferring information;

  • that it is their responsibility to take all necessary steps to ensure that the technical characteristics of their equipment enable them to consult the content of the Site.

ARTICLE 7 - MISCELLANEOUS PROVISIONS

Should any provision of the GCU be declared null and void or inapplicable pursuant to a law, regulation or final court decision, it shall be deemed unwritten and the other provisions shall remain in force.

Contractual relations between the Company and the User are governed solely by the provisions of the GCU.

ARTICLE 8 - DISPUTES

These GCU are governed by French law. 

Any dispute arising from the formation, interpretation or performance of these GCU shall be submitted to the competent French courts within the jurisdiction of the Amiens Court of Appeal, without prejudice to the mandatory provisions of the French Code of Civil Procedure.
